Terms & Conditions for Purchases of Tickets from Seattletixx

The following terms and conditions along with any other policies or guidelines posted on this site shall govern your use of this site. If you visit our site or make a purchase, you are agreeing to the following terms and conditions. Please read through them before making a purchase. Purchasing tickets from a ticket broker can be much different than directly from the box office.


Purchasing

Seattletixx™ (hereinafter “Provider”) provides you the purchaser (hereinafter “Purchaser”) the service of locating tickets for the Purchaser which are not available through normal channels.  Tickets are purchased specifically for Purchaser upon his/her placement of an order.

  • Ticket Prices. All seats are sold above face value.  This is due to the service we provide and the cost of securing Purchaser’s seat.  Prices quoted include a service charge over the face value which varies with each ticket.  This includes quality of seat, supply and demand, popularity of event and cost of securing premium seats to these events.
      • Please note that tickets to very popular events such as the Super Bowl can be several times above face value.
      • All prices are guaranteed at the time the order is processed and confirmed*.
      • All prices are quoted in U.S. Dollars unless otherwise stated.
        • Confirmation* - Purchaser’s Ticket request via checkout starts the confirmation process.  Once Purchaser’s credit card is ran and approved, Purchaser’s order is confirmed.
  • Internet Sales are not in real time; therefore, all tickets are subject to availability and change.
    • Ticket availability and prices quoted are subject to change without notice.
      • Ticket prices and availability are not guaranteed until orders are confirmed*.
      • Provider further reserves the right to refuse any order at our discretion.
      • We will contact Purchaser if the tickets you ordered are no longer available or if Provider is unable to fill the order as you requested.
      • Provider may offer you alternate seats if the original seats you requested are not available. Provider may also direct you back to our online ordering site to review current inventory.
  • Order Processing Purchaser will be notified by e-mail after you place your ticket request confirming that Provider has received it. This does not confirm availability or prices. It only indicates that we have received your request for those tickets. You will receive an additional email once your order has been filled. Just because you have not yet received an order confirmation does not mean that we have not begun performing our service or already purchased the tickets you requested on your behalf. If you do not receive an order confirmation or updated status, please call our office to check on your order.
      • NEVER assume your order is cancelled simply because you have not yet been contacted by us.
      • Online orders placed past 5:00 PM P.S.T. weekdays may not be processed until the next business day.
      • Online orders placed on weekends or holidays may not be processed until the following business day after the full weekend or holiday.
      • Provider is not responsible for email confirmation not received by Purchaser.

Returns

There are no exchanges or cancellations on any order once it is submitted to us. This is necessary because we have purchased tickets from the listing seller on your behalf and we are unable return them.

  • All Sales Are Final: Provider purchases tickets from the listing seller, therefore all sales are final! No cancellations, refunds, or exchanges are allowed once a purchase is made from Provider.
    • In the event of a rescheduled show:
      • No cancellations, refunds, or exchanges.
      • If an event is postponed, the tickets will be honored for the new date of the show.
      • New tickets will not be issued.
      • In case of a rainout or strike for a sporting event, no refunds will be made. All events purchased through us should be considered as "rain-or-shine" final purchases.

 

    • If an event is cancelled for any reason other than an Act of God or Nature*:
      • A refund up to no greater than the original face value of the ticket will be issued to the Purchaser, less shipping and handling charges (shipping and handling expense will never be refunded), provided the following occurs
        • The tickets must be received by this office within ten (10) business days from the date of the announcement of the cancellation.  After ten (10) days from the date of the announcement of the cancellation, you may need to return tickets directly to the box office for a face value refund only.
        • We suggest you return the tickets via certified, insured mail, or Federal Express, or with any other carrier that can provide Purchaser with Proof of Delivery.  Provider is not responsible for any messenger charges incurred.

*Act of God or Nature: This includes, but is not strictly limited to, natural disasters such as earthquakes or hurricanes, flooding, an act of terrorism, declaration of war, death or illness of the performer(s),

Consignment of Tickets: Please order tickets only after you are certain you want them. If you would like to sell the tickets that you purchased from us you can contact our consignment department for assistance. Since consignment tickets are your property you need to communicate with us as to the price you want for your tickets and if and when you want your tickets returned to you in the event that they do not sell.

Prices & Seating   

All Prices are guaranteed at the time the order is CONFIRMED. Since tickets are bought and sold on an open market, prices are subject to change at any time. When we fill the order if the price has raised you can cancel your order and your credit card will not be charged. We will never charge you more than you authorized. Since we represent thousands of ticket sellers and season ticket holders who all post tickets for sale on our website, we cannot be responsible for typographical errors within the inventory listed for sale.

  • Typographical Errors In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Provider shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.  Provider shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Provider shall immediately issue a credit to your credit card account in the amount of the charge.

When an error is found while processing your order you will be notified of the error and provided with other seating choices (if available) and also be given the option to cancel your order. Please check your tickets carefully once they arrive. Any discrepancies need to be brought to our attention within 48 hours after receiving your tickets in order to ensure the error can be rectified.

Credit Card Purchases

Please note that purchases by credit card do not grant you any variances from our terms and conditions. You are still responsible for complying with our terms and conditions. Any attempts to defraud us may result in legal action brought against you.

  • Credit card payment
    • We accept VISA, MasterCard, American Express and Discover.
      • Your name and home address must exactly match the address on your monthly credit card statement or the transaction will be denied. The billing address will be verified with your credit card company.
      • Failure to provide a correct billing address will result in delays in processing your order, which may result in tickets not being available.
      • You must be able to receive the tickets at the credit card billing address and someone must be available to sign for the tickets when they arrive.
      • In order to leave tickets without a signature, or to deliver at another location other than the billing address, we require you to complete and fax or scan to us a credit card authorization form along with legible copies of your driver's license and the credit card (front and back) that was used, or you must have a signature release on file with Federal Express.
      • Provider will not be responsible for undeliverable tickets.
        • It is a violation of law to place an order in a false name or with an invalid credit card.
      • Please be aware that if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you.
      • Fraudulent users will be prosecuted to the fullest extent of the law.
      • Placing an order through our website acknowledges that you hereby authorize Provider to charge your credit card for this order and subsequent phone purchases.

Deposits

All deposits are non-refundable. Even though you have not received the tickets yet, we have already committed to purchasing tickets for you by from third party sellers by time your order is confirmed.

Delivery

All deliveries are made via an express delivery service (FedEx, Express Mail, Messenger, etc.) and most deliveries will require a signature. It is your responsibility to be available to accept the delivery. You also agree to provide us with a secure delivery location and authorize anybody at that address to act as your agent to accept delivery of the package for you. If for any reason your tickets are returned to us or could not be delivered we will attempt to contact you to arrange for another delivery attempt. If you are unavailable or you refuse delivery of your tickets we will place the tickets back for sale on consignment and act as your agent to attempt to recover some or all of your costs.  This may be substantially less than you paid in some cases in an attempt to get you something for your tickets instead of having them expire worthless. However, if the tickets are not sold by the event date, we will return your tickets to you shortly after the event. It is always in your best interest to remain in contact with us regarding the pricing of your tickets. You also have the right at any time to request your tickets to be sent back to you prior to your event date. Simply request your tickets to be shipped in a manner that will get them back to you in time for your event. Please take into account any potential delays such as adverse weather conditions as we are not responsible under any circumstances for timely delivery of your consignment tickets.  

Lost or Stolen Tickets When you receive your tickets keep them in a safe place. Tickets cannot be replaced if they are lost, stolen or damaged. They should be treated like cash. Keep them out of that direct sunlight or heat which can damage some tickets. Once Provider has delivered the tickets to Purchaser, Provider is not responsible for the loss or damages of the tickets.  In addition, Provider will be unable to printout new tickets to replace Purchaser’s lost or damaged tickets.

  • Delivery.
    • Tickets are delivered using an express courier service, such as Federal Express.
      • We require a signature on all deliveries.
      • The courier must deliver to the address on the package.
      • The courier cannot deliver to any other address.
      • If there are specific delivery requirements, we need to know when you place your order.
    • Credit Card delivery requirements (this is for your protection).
      • Tickets are normally sent to your credit card billing address.
        • Your address will be verified with the credit card company, so the exact address where the statement is mailed is needed.
      • In the event you need to ship to an alternate address, the following will apply:
      • You will need to complete, sign and fax or scan us a credit card authorization form.
      • We may also require a signed copy of the invoice.
      • A copy of your driver's license or passport, and credit card.
        • The copy of the credit card should be front and back.
      • The order will be cancelled if the above documentation is not provided to Provider
    • Delivery without signature.
      • You will need to complete, sign and fax or scan us a credit card authorization form.
      • We may also require a signed copy of the invoice.
      •  
      • A copy of your driver's license or passport, and credit card.
        • The copy of the credit card should be front and back.
      • The order will be cancelled if the above documentation is not provided to Provider.
      • The ticket purchaser will accept 100% liability if the package is lost or stolen without obtaining a signature.
    • Re-Routing
      • A $ 15.00 fee will be charged for shipments that either are re-routed after leaving our office or are incorrectly addressed due to customer error.
        • Errors such as incorrect zip code, incorrect or missing apartment number, or other addressing error will result in the $ 15.00 fee being charged.
    • You agree to indemnify and hold us harmless from any resulting claim for tickets that are delivered late or not at all due to incomplete, inaccurate or missing information from your credit card authorization form.
      • Delivery time
    • Due to the nature of our business, delivery of tickets could be as late as the day of the event.
    • If you do not receive your tickets at least 2 days prior to the event, you must call or e-mail our office so we can track your shipment.
    • Provider is not responsible for late deliveries if you do not call us at least 2 days prior to the event to advise us that you have not received your tickets.

Translation Policy

In the event that any statement in any translated version of this web site conflicts with the English version, the statement in the English version shall prevail.

Event Dates and Times

Event dates and times printed on the face of the tickets are always subject to change. This is especially true for sporting events that are subject to television scheduling conflicts. It is important that you check with the local media to assure that you arrive at the correct time and date.

Limitations of Liability

We are not responsible for providing transportation or reimbursement of travel related expenses under any circumstances unless those items are specifically included as part of a package. Provider shall not be held responsible for damages, for delays, cancellations or unavailability of public or private transportation caused by an act of God, by acts of war, riot, strike, civil disobedience, civil commotion, by an act of the Federal or State Government, fire, flood, restricted availability, or by the occurrence of any other event beyond the control of Seattletixx ™

 Provider is not responsible for the conditions or the actions of the crowd at any event.  Purchaser assumes the risk associated with the nature of the event that Purchaser is attending.

The tickets that you purchase from us are valid and if someone is sitting in your seat when you arrive it is your responsibility to ask them to move or ask an usher to seat you. You are responsible for your actions in the venue and in the seats you purchase tickets for. You will be held liable for any inappropriate actions which may cause the original season ticket holder or Seattletixx legal and financial damages including but not limited to losing season ticket right, injuries to others, and loss of future income. Provdier is not responsible if you are injured in your seats, at the venue or transporting to and from the game. Provider is an independent ticket broker NOT affiliated with The Key Arena, Safeco Field, Seahawks Stadium, The Rose Garden, or any sports venue, box office, promoter, or team. All prices quoted by Provider reflect our costs of obtaining preferred seating. Prices subject to change without notice. We do not sell Tickets at face value. All sales are final with no refunds or exchanges.

Governing Law:  This Agreement and its performance shall be governed by the laws of the state of Washington, United States of America, without regard to its conflict of laws and provisions.

      • You consent and submit to the exclusive jurisdiction of the state and federal courts located in the state of Washington, United States of America, in all questions and controversies arising out of your use of this site and this Agreement.
      • To the extent allowed by applicable law, any claim or cause of action arising from or relating to your access or use of this Site must be brought within two (2) years from the date on which such claim or action arose or accrued.
  • General
    • Attorney's fees
      • If Provider or its affiliates take any action to enforce this Agreement and these terms and conditions, such parties will be entitled to recover from you, and you agree to pay, all reasonable and necessary attorney's fees and any cost of litigation, in addition to any other relief, at law or in equity, to which such parties may be entitled.
    • Injunctive relief
      • You acknowledge that a violation or attempted violation of any of this Agreement and these terms and conditions will cause such damage to Provider as will be irreparable, the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law.
      • Accordingly, you agree that Provider shall be entitled as a matter of right to an injunction issued by any court of competent jurisdiction, restraining such violation or attempted violation of these terms and conditions by you, or your affiliates, partners, or agents, as well as recover from you any and all costs and expenses sustained or incurred by Provider in obtaining such an injunction, including, without limitation, reasonable attorney's fees.
      • You agree that no bond or other security shall be required in connection with such injunction.
    • Termination
      • Provider may terminate this Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this Site or your failure to comply with these terms and conditions.
      • Such termination shall not affect any right to relief to which Provider and its third party providers and distributors may be entitled, at law or in equity.
      • Upon termination of this Agreement and these terms and conditions, all rights granted to you will terminate and revert to Provider and its third party providers or distributors, as applicable.
    • Assignment
      • You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.
    • Modification
      • Provider may at any time modify these terms and conditions, and your continued use of this Site will be conditioned upon the terms and conditions in force at the time of your use.
    • No warranties
      • Unless specifically agreed in writing as otherwise, all products, services, advice, merchandise and information available through this Site are provided on an "as is", "as available" basis without warranties of any kind, either expressed or implied, including but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose.
      • Without limiting the above, no warranty or guarantee is made:
        • That a User will receive the lowest available price for goods and/or services available through this Site.
        • Regarding the availability of products and/or services through this Site or, where applicable, at any participating retailer or retailer location.
        • That the use of this Site and all software, products or services associated with this Site will be error free.
        • Regarding the results that may be obtained from the use of this Site.
        • Regarding the completeness, accuracy, reliability or quality of any information content, data, service, advice or merchandise provided or available through this Site.
        • You expressly agree that the use of this Site is at your sole risk.
    • Third parties
      • If you use this Site to submit orders for or on behalf of a third party ("Third Party"), you are responsible for any error in the accuracy of information provided in connection with such use.
      • In addition, you must inform the Third Party of all Terms and Conditions applicable to all products or services acquired through this Site include all rules and restrictions applicable thereto.
      • Each User using this Site for or on behalf of a Third Party agrees to indemnify and hold Provider and/or its agents, employees, and/or affiliates (Covered Party) harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third Party's or the User's failure to fulfill any of its obligations as described above.
      • User is directly responsible for any orders submitted included related fees, charges and performance obligations.
    • Additional terms
      • Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this Site, and you agree to abide by such other terms and conditions.
    • Severability
      • These terms and conditions shall be deemed severable , in the event that any provision is determined to be unenforceable or invalid; such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
    • Headings
      • The heading used in this Agreement is included for convenience only and will not limit or otherwise affect the terms and conditions herein.
    • Age
      • You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this Site.
    • Personal Use
      • This Site is intended for personal, noncommercial use.
    • Ticket disclaimer
      • This tickets purchased from this Site are a revocable license and may be revoked and admission refused upon returning the printed price thereon.
      • The facility reserves the right to refuse admission or eject any person violating facility rules, local, state, or federal law, or whose conduct is deemed illegal, disorderly, or offensive by management.
      • Persons entering each facility are subject to being searched for contraband, alcohol, controlled substances, weapons, firearms, fireworks, cameras, video equipment, recording devices which are expressly forbidden in or on facility premises and subject to confiscation.
      • No smoking in facility.
      • No re-entry to facility on ticket stubs.
      • No bottles, coolers, or containers allowed in facility.
      • Seattletixx(TM), the building management, producers, its agents and participants assume no liability for injuries sustained by ticket holder while in attendance at this event.
      • Seattletixx(TM) shall not be liable if the event producers make any changes to the event, seating configuration, time, and/or date.
    • E-Mail
      • None of the Covered Parties are responsible for any errors or delays in responding to an order caused by an incorrect e-mail address provided by you or other technical problems beyond their control.
    • Entire agreement
      • This Agreement, together with any terms and conditions incorporated herein or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and supersedes any prior understanding or agreement (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this Site.
  • Agreement acceptance
    • Submitting an order online or via fax indicates your AGREEMENT to these terms and conditions.
